ORDINANCE __________________

AN ORDINANCE relating to the Department of Parks and Recreation; abandoning the unexpended and unencumbered balances of certain appropriations made from the Emergency Subfund.

WHEREAS, Ordinance 120115 appropriated the sum of One Million Four Hundred Thousand Dollars ($1,400,000) from the Emergency Account of the Emergency Subfund to pay for the costs of environmental remediation in Gas Works Park; and

WHEREAS, the environmental remediation work at Gas Works Park was completed in May 2001; and

WHEREAS, Ordinance 120180 appropriated the sum of Four Hundred Ninetythree Thousand Dollars ($493,000) from the Emergency Account of the Emergency Subfund to pay for emergency repairs to the roadway structure and retaining wall of the Southwest side of Magnolia Boulevard (Magnolia Boulevard-Drainage Repair Project) as part of Capital Improvement Program K721003; and

WHEREAS, Ordinances 120180 and 120436 appropriated a total amount of One Million Two Hundred Sixty-seven Thousand Two Hundred Dollars ($1,267,200) from the Emergency Account of the Emergency Subfund to pay for emergency work on the west side of Aurora Avenue at approximately the 1700 and 1900 block (Queen Anne Greenbelt-Drainage Repair Project) as part of Capital Improvement Program K721003; and

WHEREAS, after completion of the remediation project at Gas Works Park and the emergency repair projects at Magnolia Boulevard and Aurora Avenue there remain unexpended and unencumbered emergency funds appropriated by Ordinances 120115, 120180, and 120436;

NOW THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Department of Parks and Recreation capital project appropriations from the displayed funding sources for the following projects are abandoned effective April 30, 2002 in the respective amounts listed or in such lesser amount as remains unexpended and unencumbered from each appropriation and funding source as of that date.

Section 2. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.

Section 3. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
