ORDINANCE _________________ AN ORDINANCE relating to security from terrorism; authorizing an agreement with the federal Department of Homeland Security, Office for Domestic Preparedness (DHS/ODP), for financial assistance under the Urban Areas Security Initiative (UASI) Grant Program I; authorizing applications for allocations of funds under that agreement; recognizing that the Police Department will serve as the Program Administering Agency for UASI Grant Program I; authorizing the City to partner with the State of Washington and King County to receive funding from DHS/ODP under UASI Grant Program II; authorizing applications for allocations of funds under that grant program; increasing appropriations to the Police Department, the Fire Department, Seattle Public Utilities, Seattle Transportation, City Light, the Department of Information Technology, and the Fleets and Facilities Department in the 2003 Budget; adding a position in the Police Department; and adding a position in Seattle Transportation; all by a three-fourths vote of the City Council. WHEREAS, President Bush approved the National Strategy for Homeland Security in 2002, which is a national effort to prevent and respond to acts of terrorism in the United States that recognizes the vital role of state and local governments in combating terrorism; and WHEREAS, as part of the National Strategy for Homeland Security, the City of Seattle has been selected as one of seven major cities to receive funding under the UASI Grant Program I from DHS/ODP and has been awarded Eleven Million Two Hundred One Thousand Dollars ($11,201,000); and WHEREAS, the Police Department has been duly appointed by the Mayor of Seattle to serve as the "program administering agency" (PAA) for the City of Seattle under the UASI Grant Program I; and WHEREAS, the PAA has organized an Urban Area Working Group, hereinafter referred to as the Steering Committee, to assist in administering UASI Grant Program I activities; and WHEREAS, local jurisdictions are authorized by DHS/ODP to request an initial allocation from UASI Grant Program I, up to twenty-five percent (25%) of the total award, for immediate resource needs pertaining to conducting a Vulnerability Assessment and the development of an Urban Area Homeland Security Strategy; and WHEREAS, upon successful submission of a timely Vulnerability Assessment and an Urban Area Homeland Security Strategy to DHS/ODP, the City of Seattle will be eligible to apply for the remainder of the awarded UASI Grant Program I funding; and WHEREAS, the Seattle Urban Area has been selected as one of 30 urban areas to receive funding from DHS/ODP under UASI Grant Program II to be administered by the State of Washington, Military Department, Emergency Management Division, serving as the "state administering agency" (SAA), and the state has been awarded under this program Eighteen Million One Hundred Eighty Six Thousand Six Hundred Eighty Eight Dollars ($18,186,688), of which at least eighty percent (80%) must be passed through directly to the Seattle urban area; and WHEREAS, for purposes of UASI Grant Program II, the Seattle Urban Area encompasses the City of Seattle and King County, or "core city" and "core county," respectively, and the contiguous jurisdictions of Pierce County and Snohomish County; and WHEREAS, together with the SAA, the City of Seattle, represented by the Seattle Police Department, King County, and the contiguous jurisdictions of Pierce County and Snohomish County form the Urban Area Workgroup; and WHEREAS, under UASI Grant Program II, selected urban areas are authorized to apply for up to twenty five percent (25%) of the total award for immediate resource needs pertaining to conducting a Vulnerability Assessment and the development of an Urban Area Homeland Security Strategy; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. The Chief of Police or his designee is authorized to execute for and on behalf of the City of Seattle, an agreement with DHS/ODP, and all ancillary documents he reasonably deems necessary, for the receipt of UASI Grant Program I funds in the amount of up to Eleven Million Two Hundred One Thousand Dollars ($11,201,000) to address the unique equipment, training, planning and exercise needs of large urban areas to prevent, respond to, and recover from threats or acts of terrorism. The Police Department is recognized as the program administering agency (PAA) for the City of Seattle under the UASI Grant Program I. Section 2. Pursuant to the grant agreement authorized in Section 1, the Chief of Police or his designee is authorized to apply for up to One Million Five Hundred Ninety Seven Thousand Three Hundred Dollars ($1,597,300), which is the portion of the twenty five percent (25%) initial allocation that has been approved by the Steering Committee, for purposes of conducting required assessment work, purchasing personal protective equipment, and development work on the Urban Area Homeland Security Strategy required by DHS/ODP. After the Vulnerability Assessment and the Urban Area Homeland Security Strategy have been submitted to and approved by DHS/ODP, the Chief of Police or his designee is authorized to apply for remaining funding up to the total amount awarded and authorized in Section 1 above. No such future allocations shall be spent, however, unless appropriated by ordinance. Section 3. The Chief of Police or his designee is authorized to execute for and on behalf of the City of Seattle all agreements and ancillary documents he reasonably deems necessary to partner with the State of Washington, King County, and other local jurisdictions to participate in UASI Grant Program II and receive funding from the urban area's total award of Eighteen Million One Hundred Eighty Six Thousand Six Hundred Eighty Eight Dollars ($18,186,688), to increase the capacity of the Seattle urban area to prevent, respond to, and recover from threats or acts of terrorism. Section 4. Pursuant to the grant program described in Section 3, the Chief of Police or his designee is authorized to apply for up to One Hundred Fifty Thousand Dollars ($150,000), which is the portion of the twenty five percent (25%) initial allocation that has been authorized by the Urban Area Working Group, for purposes of conducting assessment work and for grant management. After the Vulnerability Assessment and the Urban Area Homeland Security Strategy have been submitted to and approved by DHS/ODP, the Chief of Police or his designee is authorized to apply for remaining funding up to the total amount awarded and authorized in Section 3 above. No such future allocations shall be spent, however, unless appropriated by ordinance. Section 5. The funds to be received pursuant to Sections 1 through 4 above are hereby accepted. When received, the funds applied for under the first sentence of Section 2 and the first sentence of Section 4 shall be deposited in the funds named in Section 6 to reimburse for appropriations made in Section 6. Section 6. In accordance with RCW 35.32A.060, by reason of the facts above stated, the foregoing appropriations are made to meet actual necessary expenditures of the City for which no appropriation has been made due to causes which could not reasonably have been foreseen at the time of the making of the 2003 Budget. Unspent funds so appropriated shall carry forward to subsequent fiscal years until they are exhausted or abandoned by ordinance. Section 8. To provide personnel resources to handle the additional workload as a result of the agreements authorized in Sections 1 and 3, the following positions are created in the Police Department and in Seattle Transportation. Section 9. The City intends that when grant funding is no longer available, the Planning & Development Specialist II position will be abrogated and the cost of the Emergency Preparedness Officer position will be absorbed in the annual operating budget of Seattle Transportation. Section 10. Any act consistent with the authority but prior to the effective date of this ordinance is hereby ratified and confirmed. Section 11. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
