Legislation Title: AN ORDINANCE relating to security from terrorism; authorizing an agreement with the federal Department of Homeland Security, Office for Domestic Preparedness (DHS/ODP), for financial assistance under the Urban Areas Security Initiative (UASI) Grant Program I; authorizing applications for allocations of funds under that agreement; recognizing that the Police Department will serve as the Program Administering Agency for UASI Grant Program I; authorizing the City to partner with the State of Washington and King County to receive funding from DHS/ODP under UASI Grant Program II; authorizing applications for allocations of funds under that grant program; increasing appropriations to the Police Department, the Fire Department, Seattle Public Utilities, Seattle Transportation, City Light, the Department of Information Technology, and the Fleets and Facilities Department in the 2003 Budget; adding a position in the Police Department; and adding a position in Seattle Transportation; all by a three-fourths vote of the City Council.

 

 

·        Summary of the Legislation:  This legislation authorizes the Police Department to execute an agreement with the Department of Homeland Security, Office for Domestic Preparedness (DHS/ODP) for financial assistance in the amount of $11,201,000 under Urban Areas Security Initiative (UASI) Grant Program I.  Additionally, the ordinance authorizes the Police Department to apply for an initial allocation of $1,597,300 to be reimbursed by DHS/ODP for equipment, training, planning and exercise needs associated with preventing, responding to, and recovering from threats or acts of terrorism.  This legislation also authorizes the Police Department to execute an agreement to partner with King County and the State of Washington to receive funding from DHS/ODP under UASI Grant Program II, whereby the Seattle urban area will receive at least 80% of the $18,186,688 award under that program.  This legislation further authorizes the Police Department to apply for an initial allocation of $150,000 (to be reimbursed by DHS/ODP) to administer Seattle’s UASI program.  Finally, the ordinance authorizes the creation of two FTE’s: a Planning and Development Specialist II in the Police Department, and an Emergency Preparedness Officer in Seattle Transportation.

 

·        Background: President Bush approved the National Strategy for Homeland Security in 2002, which is a national effort to prevent and respond to acts of terrorism in the United States that recognizes the vital role of state and local governments in combating terrorism.  Funding authorized for state and local governments under UASI Grant Programs I and II reflects the intent of Congress and the Administration to enhance and quantify the preparedness of the nation to combat terrorism.  The UASI Grant Program’s mission is to build a sustainable and measurable increase in the capability of critical urban areas to prevent, deter, and respond to terrorist attacks within the United States.

·        What is the financial cost of not implementing the legislation? The costs to the City of not implementing the legislation include the loss of funding to conduct an initial vulnerability assessment, purchase personal protective equipment for first responder agencies, and to develop an Urban Area Homeland Security Strategy required by DHS/ODP.  In addition, not completing this initial assessment and strategy development work will result in the City of Seattle and contiguous jurisdictions being ineligible to receive the remaining funding available under UASI Grant Programs I and II.

 

·        What are the possible alternatives to the legislation that could achieve the same or similar objectives?  Using scarce General Subfund and utility resources to conduct the assessments and purchase the equipment.

 

·        Is the legislation subject to public hearing requirements:  No.

 

·        Other Issues:  The overarching goal of the UASI Grant Program is to build a sustainable and measurable increase in the capability of critical urban areas, including the Seattle Urban Area, to prevent, respond to and recover from terrorist attacks within the United States.  The funding authorized in this Ordinance will provide immediate resource needs pertaining to conducting a Vulnerability Assessment and the development of an Urban Area Homeland Security Strategy.  Successful submission of a Vulnerability Assessment and an Urban Area Homeland Security Strategy to DHS/ODP will ensure that the City of Seattle is eligible to apply for the remainder of UASI Grant Program I & II funding.  The remainder is expected to be available beginning January, 2004.
