AN ORDINANCE relating to the Strategic Planning Office; authorizing execution of a Waterfront Parking Project Agreement; accepting funds from project partners; and increasing the appropriation authority therefor in the 2001 Adopted Budget of the Strategic Planning Office, all by a three-fourths vote of the City Council. WHEREAS, the City adopted a Downtown Plan in 1985 and a Harborfront Public Improvement Plan in 1987, proposing revitalization of the downtown Elliott Bay Waterfront though public and private investments that would reunite the waterfront with the downtown, strengthen its maritime character, and enhance public access; and WHEREAS, those plans have been substantially implemented through actions such as the development of the Bell Harbor International Conference Center, Cruise Ship facilities, retail, office and residential development; and WHEREAS, further implementation of those plans through the development of a new Pacific Northwest Aquarium, the Olympic Sculpture Park, a new waterfront hotel and potential re-use of Pier 48 is currently planned or under development; and WHEREAS, these waterfront uses have increased and will further increase the demand for travel to waterfront destinations, including the demand for parking facilities for automobile trips; and WHEREAS, the Strategic Planning Office has formed a partnership with the Department of Parks & Recreation, the Metropolitan Improvement District, the Pike Place Market Preservation & Development Authority, and the Port of Seattle to address waterfront parking issues; and WHEREAS, the increased demand for parking presents challenges to the partners and the interests of the businesses, organizations, and citizens represented by the partners; and WHEREAS, the partners believe that those challenges may most efficiently and effectively be addressed through the development and implementation of a Waterfront Parking Strategy; and WHEREAS, the goals of the Waterfront Parking Strategy are as follows: to provide comprehensive parking solutions for waterfront cultural, recreational, retail and tourism activities; to provide solutions that do not overwhelm the area with additional traffic or detract from commercial and residential parking supply; and to identify investments in pedestrian and transit connections that make off-site parking solutions feasible; Now, Therefore, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. The Director of the Strategic Planning Office is authorized to execute a Waterfront Parking Project Agreement substantially in the form attached hereto as Exhibit A. Section 2. In order to cover the costs of the project identified in Section 1, the expenditure allowance in the 2001 Adopted Budget of the Strategic Planning Office is increased as follows: Department Fund Line of Business Amount Executive General Subfund Strategic Planning $17,500 (00100) (X8M) Section 3. The Director of the Strategic Planning Office is authorized to accept funds from the Metropolitan Improvement District, the Pike Place Market Preservation and Development Authority, and the Port of Seattle, as identified in Exhibit A, to cover a portion of the cost of the project identified in Section 1. The funds shall be deposited to the General Subfund upon receipt as reimbursement for the appropriation made in Section 2. Section 4. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed. Section 5. The foregoing appropriation is made to meet actual necessary expenditures of the City for which no appropriation has been made due to causes which could not reasonably have been foreseen at the time of the making of the 2001 Adopted Budget; Now, Therefore, in accordance with RCW 35.32A.060, by reason of the facts above stated, this ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020. PROJECTS AND SERVICES 1. Waterfront Parking Project Defined The Waterfront Parking Project consists of the development of a Waterfront Parking Strategy through the selection and management of professional consultant services and joint efforts of the Partners to implement actions recommended in the Waterfront Parking Strategy. 2. Project Management The City shall appoint a Project Manager responsible for the following: a. Developing the scope of consultant services and a Request for Proposals in consultation with the Partners and other waterfront stakeholders. b. Managing the consultant selection and contracting process, directing the work by the selected consultant, and administering all aspects of the consultant contract in consultation with the Partners. c. Providing staff support to implementation efforts of the Partners and other waterfront stakeholders. d. Convening regular meetings of the Project Advisory Team (described below). e. Serving as a central point of contact for public information about the project. 3. Project Advisory Team a. The Partners shall each appoint a member of a Project Advisory Team. b. The City's Project Manager will be a member of the Project Advisory Team. c. The Project Advisory Team will meet regularly throughout the development of the project as needed. d. Members of the Project Advisory Team will also serve as members of a panel for selection of the project consultant. The City may also appoint additional members to the selection panel. e. The Project Advisory Team will provide direction on all substantive aspects of the project. f. The Project Advisory Team will operate by consensus. II. COMPENSATION AND COMMITMENTS 1. Estimated Project Cost and Funding Commitments The cost of consulting services necessary to accomplish the project is estimated at $80,000. The Partners agree to provide the funding for these costs as follows: City of Seattle-Strategic Planning Office $47,500 City of Seattle-Department of Parks & Recreation $15,000 Port of Seattle $ 7,500 Pike Place Market Preservation & Development $ 5,000 Authority Metropolitan Improvement District $ 5,000 2. Payment To secure payment, the City shall submit invoices to the Partners upon completion of the contract for consultant services. The invoice to the Department of Parks & Recreation will be in the form of an interdepartmental work order. Payment for services shall be due within 30 days of the invoice date. 3. Pro-Rata Share In the event that the actual cost of consultant services is less than the estimated cost, the compensation due from each Partner shall be reduced on a pro-rata basis. 4. Cost Overruns The Strategic Planning Office shall be responsible for any costs in excess of the estimated project cost. III. GENERAL CONDITIONS 1. Term of Agreement The Partners agree that performance pursuant to this Agreement commenced on January 26, 2001. This agreement shall terminate December 31, 2001, unless extended by mutual agreement of all of the Partners. 3. No Relationship Established Except as expressly provided elsewhere in this Agreement, it is understood and agreed to that no agency, employment, joint venture or partnership is created between the parties by this Agreement; that no party nor any of its agents, officers or employees shall be deemed to have the right, power or authority to act for the other in any manner to create any obligation or debt binding on another party.
