ORDINANCE _________ AN ORDINANCE relating to water services of Seattle Public Utilities; revising water rates and charges and terms and conditions for service, and amending Seattle Municipal Code Chapter 21.04 in connection therewith; revising credits to low-income customers and amending Seattle Municipal Code Section 21.76 in connection therewith. WHEREAS, adopted water rates became effective January 1, 1999, and were intended to remain in effect until January 1, 2001; and WHEREAS, capital requirements and operating costs have increased in recent years in response to rehabilitation and repair needs, regulatory requirements, and environmental concerns; and WHEREAS, Ordinance 118605, adopted June 2, 1997, authorizes SPU to fund public infrastructure improvements to eligible housing projects and to recover the public infrastructure costs through increased water rates; and WHEREAS, SPU has funded $ 1,281,578 in public infrastructure improvements for "eligible projects" as they are defined in Ordinance 118605 of which $ 239,170 were water improvements financed largely by 30 year water revenue bonds; and WHEREAS, the intent of the City is to recover the public infrastructure costs over a thirty year period through water rates charged to such eligible projects; and WHEREAS, franchise fees imposed by the City of Shoreline on the portion of the City of Seattle's water system located in the City of Shoreline will be recovered through a franchise charge in the water rates for customers in Shoreline; and WHEREAS, Resolution 28553, adopted July 6, 1992, established general ratemaking policies for water rates; and WHEREAS, the water rates authorized by this ordinance are consistent with policies set forth in Resolution 28553; and WHEREAS, the costs of the Cedar River Watershed HCP and other costs associated with Endangered Species Act response, totaling a 3.5 per cent rate increase, were not included in the rates set for 1999-2000 by Ordinance 119385; and WHEREAS, credits for qualified low-income customers need to be revised when the water rates change; and WHEREAS, the outside city commercial rates effective January 1, 2000 were inadvertently omitted from Ordinance 119385; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. Seattle Municipal Code Section 21.04.430, Ordinance 65877, as last amended by Ordinance 119267, is amended as follows: SMC 21.04.430 Rates inside City. All water used inside the City for domestic and commercial purposes shall be supplied by meter only at the following rates and charges. Seasonal rates shall be prorated. The additional cost of funding the Cedar River Watershed Habitat Conservation Plan and other Endangered Species Act programs shall be specifically indicated in the billings. Seattle Public Utilities shall continue to incorporate arts funding into its capital projects constructed within the municipal boundaries of the City; however the department shall not be permitted to fund any such program from the water fund on any capital project outside the City limits. A. Residential. received funding from Seattle Public Utilities for public infrastructure improvements (as defined by Seattle Municipal Code section 21.04.280) for water purposes shall be based on a commodity charge and a base service charge, in accordance with the

Residential $1.35 per month.

A. Drainage, Wastewater, and Water. Persons qualified by the Department of Housing and Human Services as eligible recipients of low income utility credits provided for in Section 21.76.010 (eligible recipients) shall be granted low income billing credits in the following amounts: 3. Water. Eligible recipients billed directly by Seattle Public Utilities for water delivery and residing in single-family dwellings shall receive a credit equal to 0.5 times the current billing. Eligible recipients not billed directly by Seattle Public Utilities for water delivery and residing in single-family or duplex dwellings shall receive the following credits: Effective January 1, 1999 $ 8.29 per month
Eligible recipients not billed directly by Seattle Public Utilities for water delivery and residing in multifamily dwellings shall receive the following credits: Effective January 1, 1999 $ 3.28 per month
Section 4. Any act consistent with authority and prior to the effective date of this ordinance is hereby ratified and confirmed. Section 5. The provisions of this ordinance are declared to be separate and severable. If any one or more of the provisions of this ordinance shall be declared by any court of competent jurisdiction to be contrary to law, then such provision or provisions shall be null and void and severed from the rest of this ordinance, and all other provisions of this ordinance shall remain valid and enforceable. Section 6. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
