AN ORDINANCE concerning the Seattle School Traffic Safety Committee; affirming the purpose of the Committee; revising the membership composition and appointment process; clarifying its responsibilities; superseding Ordinance 104344; and amending Sections 3.80.010, 3.80.020, 3.80.030 and 3.80.040 of the Seattle Municipal Code.

WHEREAS, the School Traffic Safety Committee was established in 1975 to improve traffic safety for all of Seattle's school children; and

WHEREAS, the School Traffic Safety Committee has effectively addressed safety concerns for many schools, both public and private; and

WHEREAS, the active coordination of school, transportation, and traffic enforcement professionals plays an important role in the review and analysis of school traffic safety concerns; and

WHEREAS, the active involvement of parents, and of bicycle and pedestrian advocates, in advising schools and local agencies is helpful to ensure thorough consideration of school traffic safety concerns; and

WHEREAS, Seattle had created a Seattle Safe Routes to School program to promote school traffic safety and encourage walking and biking to school; and

WHEREAS, the School Traffic Safety Committee could be made more effective by revising the membership composition and appointment process and by clarifying the Committee's responsibilities; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Section 3.80.010 of the Seattle Municipal Code, which was last amended by Ordinance 118409, is amended as follows:

3.80.010 Membership.

The City of Seattle School Traffic Safety Committee (called the "Committee" in this chapter) shall consist of (( nine (9) )) 11 members who shall serve without compensation. The members shall include the following:

A. One representative from the Seattle Police Department, to be designated by the Chief of Police;

B. One (( (1) )) representative from Seattle transportation, to be designated by the Director of Transportation;

C. Two (( (2) )) representatives from Seattle Public School District No. 1, to be designated by the Superintendent of Seattle Public Schools;

D. (( One (1) representative designated by the Evergreen Safety Council;

E. )) One (( (1) )) representative (( designated by the Seattle Council of the Parent-Teacher-Student Association )) of parents, to be appointed by the Mayor and confirmed by a majority of the City Council ;

(( F. One (1) representative designated by the Automobile Club of Washington; ))

E. One representative from King County Metro, to be designated by the Metro Transit General Manager;

(( G )) F . (( Two (2) )) Three at-large members to be appointed by the Mayor and confirmed by a majority of the City Council(( , one (1) of whom must be representative of private schools in Seattle. )) ;

G. One member representing pedestrian safety or serving on the Seattle Pedestrian Advisory Board, to be appointed by the Mayor and confirmed by a majority of the City Council;

H. One member representing bicycle safety or serving on the Seattle Bicycle Advisory Board, to be appointed by the Mayor and confirmed by a majority of the City Council.

Section 2. Section 3.80.020 of the Seattle Municipal Code, last amended by Ordinance 104344, is amended as follows:

3.80.020 Term of office.

Committee members shall serve (( a term determined by the designating authority, with the exception of the two (2) members appointed by the Mayor and confirmed by the City Council, who shall serve )) three (( (3) )) year terms. Atlarge members shall serve staggered terms with the initial term of the first at-large member to be confirmed for one year, the second member for two years, the third member for three years, and thereafter all to be three years. Members whose terms have expired may serve within the succeeding term until reconfirmed or replaced. Commencing in 2013, the next term of office will start on April 1, 2013, and subsequent terms shall commence on each April 1 regardless of whether a person holding the office serves out a full term. Any vacancy shall be filled by the appointing authority designated in Section 3.80.010 for the vacant position. Should a person take office at any time after commencement of a regular term, the expiration of that term shall remain unaffected.

Section 3. Section 3.80.030 of the Seattle Municipal Code, last amended by Ordinance 104344, is amended as follows:

3.80.030 Powers and duties.

(( The Committee's powers and duties shall include the following )) The Committee shall :

A. Advise the Mayor and the City Council and maintain liaison with Seattle Public School District No. 1 and other appropriate agencies with respect to school traffic safety complaints and proposals, including but not limited to such matters as adult crossing guards, crosswalks, pedestrian overpasses, traffic signals and signs, student transportation, school traffic safety patrol, bicycle facilities, sidewalks, and temporary walkways and traffic safety education;

B. Review and evaluate studies concerning school traffic safety and report to appropriate individuals and agencies;

C. Review and evaluate policies and procedures of agencies involved in school traffic safety;

D. Promote the coordination of individuals and agencies involved in school traffic safety;

E. Develop and recommend school traffic safety programs;

F. Promote public understanding of and participation in school traffic safety programs;

G. Make recommendations for legislation relating to school traffic safety; and

H. Perform such additional school traffic safety (( duties )) functions as the Mayor and City Council may direct.

I. Promote implementation of Safe Routes to School programs in all Seattle schools including education, encouragement, evaluation, enforcement, and engineering solutions to traffic safety issues.

Section 4. Section 3.80.040 of the Seattle Municipal Code, last amended by Ordinance 104344, is amended as follows:

3.80.040 Adoption of rules---Selection of Chairperson.

The Committee shall annually elect a Chairperson from among its members and shall adopt (( rules and regulations )) guidelines necessary to exercise its (( powers and perform its duties )) responsibilities .

Section 5. Ordinance 104344, passed March 10, 1975 and establishing a City of Seattle School Traffic Advisory Committee, is hereby superseded.

Section 6. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
