ORDINANCE
AN ORDINANCE relating to the Seattle Police Department, fixing compensation and providing certain conditions of employment for certain public safety positions and assignments; authorizing execution of a Memorandum of Understanding between The City of
Seattle and the Seattle Police Management Association, effective through December 31, 1998; a collective bargaining agreement effective through December 31, 2001; superseding inconsistent ordinances and providing payment therefor.
WHEREAS, a Collective Bargaining Agreement between the City and the Seattle Police Management Association, as the representative of certain City employees, expired on December 31, 1997; and
WHEREAS, said employees continued to work after December 31, 1997, on condition that the subject of their wages was and continued to be negotiated during collective bargaining; and
WHEREAS, collective bargaining has led to an agreement concerning wages and certain other conditions of employment between the City and the Seattle Police Management Association; and
WHEREAS, a certain employee in a Police Department nonrepresented assignment also continued to work after December 31, 1997, without a wage increase or change in other conditions of employment during the described negotiations, and the Police Department
understands that the wages and certain conditions of employment of that employee should be consistent with the negotiated Collective Bargaining Agreement between the City and the Seattle Police Management Association; Now, Therefore,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. As requested by the Personnel Director and recommended by the Mayor in the materials attached hereto, the Mayor is hereby authorized for and on behalf of the City to execute a Memorandum of Understanding with the Seattle Police Management
Association to extend through December 31, 1998, the terms and conditions of the Collective Bargaining Agreement which expired December 31, 1997. The Memorandum of Understanding is substantially in the form attached hereto and identified as "Memorandum
of Understanding by and between The City of Seattle and the Seattle Police Management Association."
Section 2. As requested by the Personnel Director and recommended by the Mayor in the materials attached hereto, the Mayor is hereby authorized for and on behalf of the City to execute a Collective Bargaining Agreement with the Seattle Police
Management Association effective through December 31, 2001, substantially in the form attached hereto and identified as "Agreement by and between The City of Seattle and the Seattle Police Management Association" with Appendix "A" thereto setting forth
rates of pay for the classes of positions listed therein effective January 6, 1999.
Section 3. As recommended by the Personnel Director, the salary rates for the position titles within the Seattle Police Management Association bargaining unit are hereby changed pursuant to the attached Memorandum of Understanding and "Appendix A" of
the attached Collective Bargaining Agreement.
Section 4. The wages and health care benefits of uniformed personnel assigned as Administrative Assistant to the Chief of Police shall be identical to the wages and health care benefits provided to Police Captains within the Seattle Police Management
Association bargaining unit under the terms of the Memorandum of Understanding authorized in Section 1 and the Collective Bargaining Agreement authorized in Section 2.
Section 5. The Police Department is hereby authorized to use unexpended and unencumbered salary funds accumulating in the Budget to pay the compensation authorized herein. The Finance Director is authorized to draw and pay the warrants drawn for the
compensation authorized herein.
Section 6. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.
Section 7. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal
Code Section 1.04.020.
