Legislation Title: An Ordinance relating to the Police Department; authorizing execution of an interlocal agreement with other police agencies in King County for mutual aid.

 

·        Summary of the Legislation:

The attached ordinance authorizes the Chief of Police or his designee to enter into an interlocal agreement with other police agencies within King County for mutual aid between agencies within King County that support each other in emergency situations.

 

·        Background:

Although police departments have had mutual response agreements with other police agencies in place for several years, there has never been a statewide policy for mutual aid and subsequent cost recovery relating to police agencies.  The State of Washington under legislation effective on July 27, 2003 authorized regional law enforcement planning for emergencies to include the adoption of interlocal agreements and plans within designated regions throughout the state.

 

The legislation created a state law enforcement mobilization policy board consisting of one representative from each of the nine regions of the State, with the responsibility of developing a statewide law enforcement mutual aid and cost recovery plan (the Plan), which is being modeled after the statewide plan that the fire service has had in place in Washington for several years.  The Plan calls for the signing of interlocal mutual aid agreements with agencies within our respective local areas.  In the case of Seattle, this is with other agencies within King County.  The Plan further calls for agencies within each region of the state to join together to develop a “Regional Response Plan.”  Seattle currently will be in the “South Puget Sound Region” that will consist of county and city police agencies in King, Pierce, Mason and Kitsap counties.

 

The signing of interlocal mutual aid agreements by local agencies is the cornerstone for developing Regional Response Plans throughout the state, and for subsequent statewide planning, including future cost recovery for responding to statewide major emergency events, through state or federal funds.

Notes:  This ordinance authorizes the Police Department to enter into an agreement that makes it possible for the Police Department to recover costs associated with providing mutual aid to other police agencies within King County.  Any actual costs recovered will be accounted for in future legislation.

·        What is the financial cost of not implementing the legislation?  The costs to the City of not implementing the legislation include the potential loss of recoverable expenses associated with providing mutual aid during statewide major emergency events.  Entering into local mutual aid agreements, and participating in regional response planning efforts, are cornerstones to future statewide cost recovery planning in which local agencies may be reimbursed by the Washington Military Department, Emergency Management Division for responding to major statewide emergency events.
