AN ORDINANCE relating to the Police Department;
authorizing the execution of an agreement with Todd Pacific Shipyards
Corporation for the Seattle Police Department to help provide the additional
security for United States Navy vessels in temporary dry-dock by providing
marine patrol law enforcement services in Elliott Bay; accepting payment when
received from Todd for such additional services; increasing the 2003 Budget
of the Police Department by making a reimbursable appropriation; and
ratifying and confirming prior acts; all by a three-fourths vote of the City
Council. |
· Summary of the Legislation:
The attached legislation authorizes an agreement with Todd Shipyards in the amount of $215,700 as reimbursement to the Seattle Police Department for the provision of marine patrol law enforcement services in Elliott Bay while U.S. Navy ships are in temporary dry-dock.

Background:
The U.S. Coast Guard and U.S. Navy have established regulations for the safety and security of U.S. Navy vessels in the navigable waters that surround Todd Shipyards in Elliott Bay and the west waterway of the Duwamish River. Todd provides routine scheduled maintenance, emergency repairs, and overhauls on a wide range of U.S. Navy ships. During the time the ships are in temporary dry-dock for repairs, they are potentially vulnerable to threats and attacks, which could compromise our national security. Since fall of 2001, Todd Shipyards has contracted with SPD to help maintain a 100-yard “Naval Vessel Protection Zone” on the saltwater surrounding the Todd site. This will be the third contract with Todd, and will last from June 1 through July 4, 2003. Todd will provide two patrol vessels for SPD to use and will fully reimburse SPD for the costs associated with providing this 24x7 enforcement.

financial cost of not implementing the legislation?
If this legislation is not
implemented, the SPD will not be able to do this work with its existing
resources and would recommend not entering into the agreement with Todd
Shipyard.

What are the
possible alternatives to the legislation that could achieve the same or similar
objectives?
As an alternative to the proposed
agreement, Todd Shipyard might use a private contractor to fulfill the service
need. This alternative service would
not be preferred because Todd would not be linked as readily with SPD Harbor
Patrol and other SPD resources for emergency response in the event of a
terrorist attack.
