AN ORDINANCE relating to the 2010 budget, lifting provisos and imposing a proviso restricting the use of appropriations for developing the Seattle Transit Master Plan. WHEREAS, the Council passed Ordinance 123325 in June, 2010, imposing restrictions on appropriations by the Executive for the purposes of developing a Transit Master Plan (TMP); and WHEREAS, the restrictions were imposed to allow the Council an opportunity to review and approve the vision, goal statement, schedule and proposed scope of work to be undertaken by the Executive for the TMP; and WHEREAS, Resolution 31238 articulates an agreed upon vision, goal statement, schedule and proposed scope of work between the Executive and the Council for the TMP; and WHEREAS, the Council intends to monitor the progress of the TMP, review and provide policy guidance at key milestones and maintain the project schedule as outlined by the Seattle Department of Transportation; and WHEREAS, consistent with the joint oversight approach agreed to by the Council and Executive for the TMP and the phasing plan outlined in Resolution 31238, Council finds it appropriate at this time to approve funding and move forward with the first of two phases of work; and WHEREAS, the Council recognizes the importance of developing a comprehensive TMP that delineates and prioritizes a range of transit network investments; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. The restrictions imposed by the 12 budget provisos in Ordinance 123325 pertaining to appropriations for updating the Transportation Strategic Plan's Seattle Transit Plan (to be renamed the Transit Master Plan) are lifted. Section 2. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Executive Department's Office of the Mayor: Proviso: The Executive Department's Office of the Mayor is authorized to spend any money from the Office of the Mayor Budget Control Level (X1A00) to coordinate with Council and Council Central Staff to frame for Council review and approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from the Office of the Mayor Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 3. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Major Projects Budget Control Level (19002) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Major Projects Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Major Projects Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 4. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Major Maintenance/Replacement Budget Control Level (19001) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Major Maintenance/Replacement Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Major Maintenance/Replacement Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 5. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the MobilityCapital Budget Control Level (19003) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Mobility-Capital Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Mobility-Capital Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 6. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Bridges & Structures Budget Control Level (17001) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Bridges & Structures Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Bridges & Structures Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 7. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Department Management Budget Control Level (18001) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Department Management Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Department Management Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 8. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Engineering Services Budget Control Level (17002) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Engineering Services Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Engineering Services Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 9. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the General Expense Budget Control Level (18002) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's General Expense Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's General Expense Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 10. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the MobilityOperations Budget Control Level (17003) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Mobility-Operations Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Mobility-Operations Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 11. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the ROW Management Budget Control Level (17004) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's ROW Management Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's ROW Management Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 12. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Street Maintenance Budget Control Level (17005) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Street Maintenance Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Street Maintenance Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 13. Ordinance 123177, adopting the 2010 Budget, is amended by deleting the following proviso to the Urban Forestry Budget Control Level (17006) in the Seattle Department of Transportation Budget. Proviso: The Seattle Department of Transportation (SDOT) is authorized to spend any money from SDOT's Urban Forestry Budget Control Level to coordinate with Council and Council Central Staff to frame for Council's review and future approval the vision, goals, schedule, and scope of work to update the Transportation Strategic Plan's Seattle Transit Plan (STP); however, no money, not yet encumbered or expended, from SDOT's Urban Forestry Budget Control Level may be spent or encumbered for any other staff or consultant work to implement the update to the STP until authorized by future ordinance. Section 14. Ordinance 123177, adopting the 2010 Budget, is amended by adding the following proviso: No more than $300,000 appropriated in the 2010 budget for the Seattle Department of Transportation (SDOT) may be spent on consulting services to develop a Transit Master Plan (TMP) until authorized by future ordinance. Council anticipates that such authority will not be granted until SDOT completes phase one of the TMP project. This maximum amount of $300,000 may be spent only on the following phase one consulting services: Project Management (Task 1) * Project scope and work plan * Team meetings * Council and Mayoral briefings Systems Analysis (Tasks 2, 4, and 5) * Existing and future conditions ("Briefing Book") * Transit system principles and performance * User experience and mode integration * Governance and funding * Gap analysis Outcome-based Evaluation Framework (Task 3) * Transit goals confirmation workshop * Prioritization of policy objectives * In-depth market assessment for priority connections * Framework for modal assignments Public Outreach and Engagement (Task 6) * Formation of public advisory committee, executive and inter-agency teams * Stakeholder roundtables and interviews * Development of project website and communications materials Section 15. This ordinance shall take effect and be in force immediately upon its approval by the Mayor or, if not approved and returned by the Mayor within ten days after presentation, then on the eleventh day after its presentation to the Mayor or, if vetoed by the Mayor, then immediately upon override of the Mayor's veto by the Council.
