AN ORDINANCE relating to the City Light Department; authorizing execution of a 15-year agreement with Redding Electric Utility for the exchange of renewable energy and environmental attributes.

WHEREAS, Redding Electric Utility ("Redding") is purchasing the capacity, energy and environmental attributes from the new Roseburg Biomass Project, a new renewable resource, located in Siskiyou County, California; and

WHEREAS, Redding is unable to economically transmit the power from this resource to its load due to transmission limitations, but the power can be transmitted to Seattle City Light ("SCL"); and

WHEREAS, SCL possesses an amount of small hydroelectric resources and environmental attributes that SCL can deliver to Redding; and

WHEREAS, both Redding and SCL desire to exchange these renewable resources and their environmental attributes, such that each can be delivered to meet the other's obligations; NOW THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. The Superintendent of City Light, or his designee, is hereby authorized to execute for and on behalf of the City of Seattle a 15-year Renewable Energy Exchange Agreement, substantially in the form attached hereto as Attachment 1. This agreement with Redding Electric Utility sets forth the terms under which Redding will deliver new renewable energy and environmental attributes to (Seattle City Light) and SCL will deliver renewable energy and environmental attributes to Redding.

Section 2. Any act consistent with the authority of this ordinance that is taken after its passage but prior to its effective date is hereby ratified and confirmed.

Section 3. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
