AN ORDINANCE relating to appropriations for solid waste facilities in the 2007 City Budget for Seattle Public Utilities; removing a budget proviso that limited expenditures on transfer station upgrades and a new intermodal facility; and amending the
Capital Improvement Program to revise project descriptions for solid waste facilities, close out the Intermodal Facility Project, and reallocate funds from the Intermodal Facility Project to the South Transfer Station Upgrade Project.
WHEREAS, the City Council adopted the 2007 City Budget by Ordinance 122298, which included a budget proviso limiting the expenditure of funds for planning transfer station upgrades to no more than $1,500,000, and restricting all expenditures for an
intermodal transport facility and the design or construction of the transfer station upgrades until Seattle Public Utilities (SPU) completed a reevaluation of the need for the facility and upgrades; and
WHEREAS, SPU completed a report entitled Seattle Solid Waste Recycling, Waste Reduction, and Facility Opportunities, dated April 2007, that was provided to the City Council; and
WHEREAS, the Council and Executive have reached an agreement on a configuration that rebuilds the North and South Transfer Stations, closes out the Intermodal Facility Project, and sets forth a strategy to further reduce the amount of garbage being sent
to landfills; and
WHEREAS, removing the budget proviso and amending the 2007-2012 Adopted Capital Improvement Program (CIP) to close out the Intermodal Facility Project, provide design goals for the North Transfer Station Upgrade project, and reallocate the remaining
appropriations from the Intermodal Facility Project to the South Transfer Station Upgrade project are consistent with the Solid Waste Facilities Master Plan and Solid Waste Plan, as amended and affirmed; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The restrictions imposed on expenditures for solid waste facilities by the following 2007 City Budget proviso are removed in their entirety and are no longer restrictions for any purpose, including for Subsection 1(b) of Ordinance 122298:

Section 2. The 2007-2012 Adopted CIP is hereby amended to close out the Intermodal Facility Project and reallocate $ 6.3 Million to the South Transfer Station Upgrade Project resulting in the total dollar amounts shown in the 2007 column as follows:

This amendment shall operate for the purposes of increasing the base for the limit imposed by Subsection 4(c) of Ordinance 122298.
Section 3. The 2007-2012 Adopted CIP is hereby amended further to replace the Intermodal Transport Facility project description in its entirety as shown in Exhibit A. Dollar amounts displayed in Exhibit A show adjustments, if any, made by other
sections of this ordinance.
Section 4. The 2007-2012 Adopted CIP is hereby amended further to add the following new sentence after the second sentence in the Solid Waste Facility Master Plan -North Transfer Station Rebuild project description: "To maintain street view corridors,
Seattle Public Utilities will strive for the North Transfer Station to be rebuilt with new buildings that are the same height as the existing building and have a footprint that is contained between Ashworth Avenue North and Interlake Avenue North."
Section 5. Any act consistent with the authority of this ordinance that is taken after passage of this ordinance but prior to its effective date is hereby ratified and confirmed.
Section 6. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal
Code Section 1.04.020.

This project formerly implemented the Solid Waste Facilities Master Plan by planning, designing and building a new solid waste intermodal transfer facility. In the wake of the "Seattle Solid Waste Recycling, Waste Reduction and Facilities
Opportunities" report, the Executive, Council and SPU decided not to build an intermodal facility but to proceed with other elements of the master plan. Remaining project budget in 2007 supports planning to date, including costs for the study, and
close-out activities.
