AN ORDINANCE relating to the Department of Parks and Recreation; authorizing acceptance of a donation of a remainder interest in certain real property consisting of Lot 1, Block 2 of Fauntleroy Crest Addition to the City of Seattle; authorizing
acceptance of a donation of cash; and establishing a sub-account in the General Donations and Gifts Account for the deposit of the cash donation.
WHEREAS, Delayne B. and George Watton approached the Department of Parks and Recreation in early May 1998 with an offer to donate their property, including residence, located at 3823 SW Willow Street in West Seattle, to the City, subject to a life
estate; and
WHEREAS, the Wattons have offered to make a Sixty Thousand Dollar ($60,000) cash donation to the City to pay for the demolition and asbestos abatement of their residence upon the expiration of the life estate; and
WHEREAS, the estimated cost in 1998 dollars for removing asbestos from the Watton residence and completing demolition has been determined to be approximately Fifty-four Thousand Dollars ($54,000); and
WHEREAS, the City has conducted an environmental review and determined that the estimate of Fifty-four Thousand Dollars ($54,000) for the demolition of the Watton residence is sufficient to cover the required work and asbestos abatement; and
WHEREAS, the 4,660 square foot Watton property, valued at approximately One Hundred Thousand Dollars ($100,000), will make an excellent "mini-park" for public viewing of Puget Sound; and
WHEREAS, the City wishes to accept the generous property and cash donations from the Wattons; Now, Therefore,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. The Superintendent of Parks and Recreation is authorized to accept, on behalf of The City of Seattle, from Delayne B. and George Watton, for open space, park and recreation purposes, a donation of a remainder interest in real property
legally described as Lot 1, Block 2 of Fauntleroy Crest
Addition to the City of Seattle concurrent with acceptance of the cash donation described in Section 2. The remainder interest shall be subject to no liens or encumbrances that could impose affirmative obligations on the City.
Section 2. The Superintendent is authorized to accept, concurrent with the donation described in Section 1, a Sixty Thousand Dollar ($60,000) cash donation from Delayne B. and George Watton for demolition and asbestos abatement of the residence on the
real property described in Section 1 upon the expiration of the Wattons' life estate. To accommodate the acceptance of this cash donation, there is hereby established in the General Donations and Gifts Account of the Department of Parks and Recreation
a sub-account, entitled the " Delayne B. and George Watton Account," for the purpose of holding the cash donation and all investment earnings attributable thereto and spending the donation and earnings on expenses related to the demolition and asbestos
abatement of the residence upon expiration of the Wattons' life estate. Any amount left in the sub-account after accomplishing this purpose shall be used for development and/or maintenance of the site. Expenditures from the account shall be on
authorizations approved by the Superintendent.
Section 3. The Superintendent or his designee is hereby authorized, on behalf of The City of Seattle, to take such other actions as may be required or appropriate in connection with the City's acceptance of the donations.
Section 4. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.
Section 5. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal
Code Section 1.04.020.
