ORDINANCE _________________
AN ORDINANCE relating to assistance for the homeless, authorizing an agreement with the United States Department of Housing and Urban Development for additional funds available under the Stuart B. McKinney Homeless Assistance Act, increasing an
appropriation to the Human Services Department in the 2003 Budget, and ratifying and confirming prior acts, all by a three-fourths vote of the City Council.
WHEREAS, as authorized by Resolution 30507 adopted October 7, 2002, the City applied for federal funds available from the United States Department of Housing and Urban Development (HUD) under the Stuart B. McKinney Homeless Assistance Act for a set of
prioritized services designed to further the regional plan for a Continuum of Care for persons who are homeless; and
WHEREAS, HUD has approved renewed funding for 18 continuing projects and one new project to be administered by the City with funding totaling $6,859,251; and
WHEREAS, the Adopted 2003 Budget for the Human Services Department appropriated revenues totaling $6,700,000 for the Stuart B. McKinney Homeless Assistance Act, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. As requested by the Director of the Human Services Department and recommended by the Mayor, the Mayor or his designee is hereby authorized to enter into an agreement for financial assistance from the United States Department of Housing and
Urban Development (HUD) for additional funds available under the Stuart B. McKinney Homeless Assistance Act (McKinney Act) in the amount of Six Million Eight Hundred Fifty-Nine Thousand Two Hundred Fifty-One Dollars ($6,859,251) beginning February 1,
2003. The Mayor or his designee is authorized to execute and deliver for and on behalf of The City of Seattle an agreement in such counterparts as may be necessary to accept the financial assistance. Funds, when received, shall be deposited into the
Human Services Operating Fund. The Mayor or his designee is further authorized to execute and deliver such other documents relating to the agreement as may be required in connection therewith. The agreement and such other documents shall be in form
and content consistent with the City Charter and other applicable law.
Section 2. Contingent upon the execution of the agreement authorized in Section 1 hereof, the appropriation for the following in the 2003 Budget is hereby increased as follows:

Unspent funds so appropriated shall carry forward to subsequent fiscal years until they are exhausted or abandoned by ordinance.
Section 3. Any act pursuant to the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.
Section 4. In accordance with RCW 35.32A.060, by reason of the facts above stated, the foregoing appropriation is made to meet actual necessary expenditures of the City for which insufficient appropriations have been made due to causes which could not
reasonably have been
foreseen at the time of the making of the 2003 Budget.
Section 5. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Seattle
Municipal Code Section 1.04.020.
