ORDINANCE _________________

AN ORDINANCE relating to City of Seattle positions of employment, abrogating each Department of Parks and Recreation position assigned to the Woodland Park Zoo that is vacant on or after December 31, 2002.

WHEREAS, Ordinance 120697 approved an agreement between the City of Seattle and the Woodland Park Zoological Society (Zoological Society), a non-profit public benefit corporation, whereby the Zoological Society assumed operational and managerial responsibility for the Woodland Park Zoo over a renewable twenty-year period, effective March 1, 2002; and

WHEREAS, an Employee Transition Plan contemplated in the management agreement between the City and the Zoological Society is expected to be submitted to the City Council by December 31, 2002, but will not be adopted until after Council reviews the Plan early in 2003, and

WHEREAS, City of Seattle employees who currently work for the Department of Parks and Recreation at the Zoo will help the Zoological Society carry out its responsibilities under the new operating agreement in the most efficient way possible by transitioning their employment to the Zoological Society; and

WHEREAS, in order to preserve all possible options for transitioning current Department of Parks and Recreation Zoo employees to the Zoological Society, the City's 2003-2004 Adopted Budget will maintain all current positions in the Zoo Program position list; and

WHEREAS, the Department of Parks and Recreation is committed to not filling any positions at the Zoo that are currently vacant or become vacant prior to December 31, 2002, because it would not further the goal of employee transition and because the City is currently under a hiring freeze; and

WHEREAS, automatic movement to the Zoological Society of City employees who are employed in areas other than at the Zoo would be contrary to the goals contemplated in the management agreement; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Any position at the Woodland Park Zoo as shown on Exhibit 1 that is vacant on or after December 31, 2002 is abrogated as a City position effective on the date of its becoming vacant.

Section 2. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.

Section 3. This ordinance shall take effect and be in full force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
