Legislation Title:

A RESOLUTION amending Procedures for the Evaluation of the Reuse and Disposal of the City’s Real Property, adopted by Resolution 29799, to update the procedures and to provide additional guidance on notice to adjacent property owners and other members of the public with respect to the disposal or reuse of City real property.

 

·        Summary of the Legislation:

This legislation amends the Procedures for the Evaluation of the Reuse and Disposal of the City’s Real Property, adopted by Resolution 29799.  The amendments provide improved notice to adjacent property owners and other members of the public regarding the disposal process for excess City property.

Improved notice will give neighborhood and non-profit groups the opportunity to identify options for reuse or sale of such property for public benefit.

 

Among other things the amendments:

  1. Extend the distance of notice to 1,000 feet and increases the range of groups and members of the public to be contacted.
  2. Require re-notification of the same groups, if the surplus process is not completed within 18 months of initial notification. 
  3. Require Fleets and Facilities Real Estate Services or the jurisdictional department to notify groups about the Executive decision to dispose of excess property prior to sending any legislation to the Council.

4.      Require the Executive to include with legislation for each excess property a report detailing the public notice process and public comment received.

The Procedures were last amended in June 1998.  In the past eight years, there have been numerous occasions when the Council received legislation regarding the surplus of excess City property where it appeared that insufficient notice and public review and comment opportunity had been provided.   Most recently, the proposed disposal of the Soundway West property by public sale created a huge amount of public concern.  As a result, the Council has worked with citizens and community based groups, as well as City departments, to improve the public notification procedures for the disposal of excess City property, resulting in this proposed legislation.
