AN ORDINANCE relating to the Mountains to Sound Greenway Trail; authorizing the Director of Transportation to sign an agreement with the Washington State Department of Transportation for State construction of a portion of the Mountains to Sound Greenway Trail on City property and State property; and authorizing the Director of Transportation to sign a lease with the Washington State Department of Transportation for City maintenance and operation of a portion of the Mountains to Sound Greenway Trail on State property. |
Summary and background of the Legislation:
This legislation authorizes the City of Seattle (City), through its Director of Transportation, to enter into a general contracting agreement (Contract) with the State of Washington through the Department of Transportation (State) for the construction of a segment of the Mountains to Sound Greenway Trail (MTS Trail) on a portion of City property and a portion of State property. This legislation also authorizes the Director of Transportation to enter into a trail lease agreement (Lease) with the State for the City’s operation and maintenance of the MTS Trail portion on State property.
In 1999, the City, in coordination with the State, received a grant to fill this gap in the MTS Trail in Seattle. Pursuant to the Contract, the State will construct an extension of the MTS Trail across City and State property. The City is responsible for the cost of construction and will reimburse the State with federal grant money the City previously received for this project. Pursuant to the Lease, the City will operate and maintain the MTS Trail segment on State property. Approximately $110,000 of City assets for security and the illumination system will be used on State property for the project.
A portion of the new MTS Trail segment goes through Dr. Jose Rizal Park, which is under the jurisdiction of the Seattle Department of Parks and Recreation (Parks). SDOT and Parks will enter into a Memorandum of Understanding to set forth working guidelines and assign maintenance functions for this segment of the MTS Trail extension.
The MTS Trail will eventually extend to the Seattle Waterfront. This proposed legislation facilitates the Seattle extension of the MTS Trail, which will extend the multi-use trail at its current terminus on Beacon Hill at the Dr. Jose Rizal Bridge along Interstate 5 to the Holgate overpass. This new segment of the MTS Trail will become part of a one-hundred mile corridor of permanent open space lands along Interstate 90 from Seattle to Central Washington. The MTS Trail embraces and complements City parks and trails, wildlife habitats, working and protected forests, recreational opportunities in nature, local history, scenic beauty, tourism, and educational activities that promote a sustainable balance between population growth and a healthy environment.

What is the financial cost of not implementing the legislation: (Estimate the costs to the City of not implementing the legislation, including estimated costs to maintain or expand an existing facility or the cost avoidance due to replacement of an existing facility, potential conflicts with regulatory requirements, or other potential costs if the legislation is not implemented):
If this legislation is not implemented, the City would have to manage the construction of the project to build this segment of the MTS Trail in lieu of the State. The City would incur approximately $250,000 to assume management of this construction project and the project would be delayed for at least 6 months. A new trail lease would also have to be negotiated between the City and State to provide for City construction on State land and a new authorizing ordinance would need to be passed by the City Council.
In addition, this grant funded project is over 10 years old and a further delay could jeopardize current funding. Due to the age of the grant Federal Highway Administration has the authority to request that the City return the unspent grant balance of approximately $810,000 and pay back the spent portion of the grant in the amount of $440,000.

Parks has jurisdiction over a portion of the new MTS Trail segment that will go through Dr. Jose Rizal Park. The Department of Transportation and Parks will enter into a Memorandum of Understanding to set forth working guidelines and designate maintenance responsibilities. Don Harris and Terry Dunning are the Parks representatives assigned to this project.
