Legislation Title:

AN ORDINANCE relating to jail services; authorizing the Mayor to execute an extension to the Interlocal Agreement with King County for the Provision of Jail Services.

·         Summary of the Legislation:

This legislation would authorize the Mayor to sign an amendment to the Interlocal Agreement with King County for jail services to extend the agreement to Dec. 31, 2015 and to implement a new rate structure.

·         Background:

King County is the primary provider of jail services for the City of Seattle.  The current interlocal agreement (ILA) with King County expires December 31, 2012.  This proposed amendment will extend the term of the agreement to December 31, 2015 and will guarantee cities that sign the amendment a total of 330 beds in 2013 and 2014, and 220 beds in 2015.

In addition, the proposed amendment to the ILA creates a new rate structure for County charges for jail services.  Instead of paying a single average daily rate, regardless of what services were provided or where an inmate was housed, the rate will vary depending on the level of medical and or psychiatric services the inmate receives.  Different fees include $106 per day for someone in general housing; $326 day for someone housed in the acute psychiatric unit; or $1,319 per day for someone at Harborview.  The booking fee will also increase from $234 to $289.

The new rate model will go into effect June 1, 2010 for Seattle and will increase the City’s 2010 charges by approximately $740,000; the ongoing annual effect is an increase of $1.26 million.  The 2010 Adopted Budget includes sufficient funding to pay for the 2010 rate increase (assuming that the number of bookings and jail days in 2010 do not exceed the budgeted projections).

X         This legislation has financial implications.

This amendment to the ILA for jail services will increase the amount the City pays for jail services.  However, the 2010 Adopted Budget for jail services is sufficient to pay these increased charges and no additional appropriation authority or funding is required (assuming that the number of bookings and jail days in 2010 do not exceed the budgeted projections).
