Legislation Title:

AN ORDINANCE relating to Magnuson Park; amending the Master Plan approved by Ordinance 121502 for the development of wetlands and wildlife habitat and an athletic field complex at Magnuson Park; expressing support for the proposed phase 2 wetlands, natural areas and athletic fields; requesting additional information from the Department of Parks and Recreation; reaffirming conditions in Ordinance 121502 for the use of external funding for wetlands, natural areas and athletic fields at Magnuson Park; and lifting a budget proviso that had restricted spending on phase 2 construction of athletic fields.

 

 

·        Summary of the Legislation:  This ordinance amends the Master Plan for the Magnuson Park sports fields complex and wetland/natural area to include two “Habitat Overlay Maps” showing the plan for the wetlands/natural area and that portion of the plan proposed to be completed as part of phase 2.  It also incorporates portions of the requested Wetland/natural area Monitoring and Adaptive Management Plan provided by the Parks Department (“Monitoring Plan for Wetland Compensatory Mitigation for Magnuson Park Phase 2 Development”, February 9, 2006).  The legislation finds that with these documents plus the requested “Phase 2 Developments and Funding Plan” the Parks Department has provided the additional information the Council requested as a prerequisite for commencing construction of the phase 2 sports field and finds that the Parks Department has identified adequate secure funding to complete the phase 2 work with the exception of sportsfield #5 work beyond grading (for which private fundraising is underway and anticipated to be completed).  It reaffirms the conditions for acceptance and use of external sources of funding in Ordinance 121502 and requires the Parks Department to demonstrate that these conditions are met prior to using sources of external funding not included in the “Phase 2 Developments and Funding Plan.”  It request that the Parks Department provide with its proposed 2008 budget a request for and documentation on 1) operations and maintenance cost necessary to successfully implement the phase 2 portion of the wetlands and natural area in a manner compliant with the Monitoring Plan and the Parks Department’s existing “Magnuson Park Vegetative Management Plan” and 2) a reasonable CIP contingency amount to remedy any problems with the phase 2 wetlands and natural areas.  

 

 

·        Background: (Include brief description of the purpose and context of legislation and include record of previous legislation and funding history, if applicable): Ordinance 121502 approving the Master Plan for the Magnuson Park sports fields complex and wetland/natural area requested the Parks Department to come back with additional information on the project before commencing construction of the phase 2 sports fields.  The Parks Department has now provided that information.  This ordinance memorializes receipt of the requested information and updates the Master Plan to incorporate it.  It does not alter any existing appropriations or make any new appropriations.
