Legislation Title:

AN ORDINANCE relating to land use and zoning; amending Chapter 23.32 of the Seattle Municipal Code at page 42 of the Official Land Use Map (Volume 6 of Plats, page 20, Records of King County) to rezone property located at 427 N.E. 72nd Street, 420 N.E. 72nd Street, and 466 N.E. 70th Street from Commercial 1 with a 40 foot height limit (C1 40) to Neighborhood Commercial 2 with a 40 foot height limit and Pedestrian 1 overlay (NC2 40 P1) and to Neighborhood Commercial 2 with a 65 foot height limit and Pedestrian 1 overlay (NC2 65 P1) and from Neighborhood Commercial 2 with a 40 foot height limit (NC2 40)  to Neighborhood Commercial 2 with a 65 foot height limit and Pedestrian 1 overlay (NC2 65 P1) and accepting a Property Use and Development Agreement in connection therewith.  (Petition of Lorig and Associates, C.F. 307017, Project Numbers 2400398, 2400399, and 240400.)

 

 

·        Summary of the Legislation:

 

This is legislation for a quasi-judicial rezone of portions of property located at 427 and 420 Northeast 42nd Street and 466 Northeast 70th Street in the Green Lake Residential Urban Village.  The proposed rezone would change the zone designation of the property from Commercial 1 with a forty foot height limit (C1 40) and Neighborhood Commercial 2 with a 40 foot height limit (NC2 40) to Neighborhood Commercial 2 with a 40 foot height limit and Pedestrian 1 overlay (NC2 40 P1) and to Neighborhood Commercial 2 with a 65 foot height limit and Pedestrian 1 overlay (NC2 65 P1) and adopt a Property Use and Development Agreement (PUDA) limiting development on the site.

 

·        Background:

 

The legislation is a petitioner-generated rezone subject to the Council’s rules for quasi-judicial decisions.  The original petition, Department of Planning and Development recommendation, Hearing Examiner’s Findings and Recommendation, and record established by the Hearing Examiner are contained in related Clerk’s File 307017.
