WHEREAS, proponents of a district system for electing members of the Seattle City Council have submitted to the Office of the City Clerk a petition bearing a facially sufficient number of signatures to qualify the proposed charter amendment filed in
Clerk File 305098 ("Proposed Charter Amendment 5") for placement on the November 2003 ballot; and
WHEREAS, the Office of the City Clerk has forwarded the petition to the King County Division of Records and Elections for verification whether the petition bears a sufficient number of valid signatures to qualify Proposed Charter Amendment 5 for
placement on the November 2003 ballot; and
WHEREAS, King County Division of Records and Elections has not yet completed the signature-verification process for this petition; and
WHEREAS, in order to place Proposed Charter Amendment 5 on the November 2003 ballot, the County must receive from the City by no later than September 19, 2003, a resolution requesting the County to place it on the November 2003 ballot; and
WHEREAS, if the County certifies that Proposed Charter Amendment 5 has qualified for the November 2003 ballot, the Office of the City Clerk and the Ethics and Elections Commission have certain legal obligations to meet in order to place the proposed
amendment on the ballot and in order to include information regarding the proposed amendment in the voters' pamphlet for the November 2003 election; and
WHEREAS, the City may, in order to meet its potential legal obligations and the associated practical deadlines, need to take certain actions before the County has completed the signature verification process;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE, THAT:
Section 1. The City Clerk is authorized and directed to take those actions necessary to place Proposed Charter Amendment 5 before the voters at the November 2003 election, including but not limited to publishing the proposed charter amendment as
provided by state law and the City charter. If it is determined that Proposed Charter Amendment 5 will not appear on the November 2003 ballot, the City Clerk is authorized and directed to cease such actions and to take any appropriate remedial
actions.
Section 2. The Executive Director of the Ethics and Elections Commission is authorized and requested to take those actions necessary to place information regarding Proposed Charter Amendment 5 in the November 2003 voters' pamphlet. If it is determined
that Proposed Charter Amendment 5 will not appear on the November 2003 ballot, the Executive Director of the Ethics and Elections Commission is authorized and requested to cease such actions and to take any appropriate remedial actions.
Section 3. If, but only if, the King County Division of Records and Elections certifies that the petition in support of Proposed Charter Amendment 5 contains a sufficient number of valid signatures to qualify the proposed charter amendment for
placement on the November 2003 ballot, the King County Division of Records and Elections is requested, in the form of this resolution, to place Proposed Charter Amendment 5 on the November 2003 ballot.
Section 4. Actions taken prior to the adoption of this resolution that are consistent with it are hereby ratified and confirmed.
