AN ORDINANCE relating to Seattle Transportation; adopting an amended schedule of fees for permits for the use of public places, such as streets and sidewalks, under the jurisdiction of Seattle Transportation, and authorizing the Director of Seattle Transportation to collect such fees in accordance with Seattle Municipal Code Chapter 15.04. WHEREAS, Section 15.04.074 of the Seattle Municipal Code authorizes and directs the Director of Seattle Transportation to prepare and recommend for adoption by the City Council by ordinance, a schedule of fees applicable to all street and/or sidewalk use permits, hereinafter Street Use Permit Fee Schedule, commensurate with the cost of administration, inspection and policing involved in the issuance and continuance of such permits and the use thereby granted; and WHEREAS, Ordinance 116439, as amended by Ordinances 116813, 118065, and 118383, adopted a Street Use Permit Fee Schedule; and WHEREAS, it is necessary to adjust fees for inflation to cover the increased costs for administration of said permits; and WHEREAS, the City finds that it is in the public interest for the department to identify and inspect those areaways that are most critically in need of structural repair, and that is appropriate to add to the Street Use Permit Fee Schedule a charge for such structural inspections, to be collected from the areaway permittee; and WHEREAS, Seattle Transportation currently charges a fee for inspections involved in the issuance and continuance of street use permits, but this fee is not shown on the Street Use Permit Fee Schedule; and WHEREAS, Seattle Transportation desires to amend the Street Use Permit Fee Schedule to show this inspection fee and adjust the fee for inflation to cover the increased costs for inspection of street use permits; and WHEREAS, the Director has prepared and recommended an amended schedule of fees as attached hereto; NOW THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. As requested by the Director of Seattle Transportation and recommended by the Mayor, the City's Street Use Permit Fee Schedule is adopted in the amended form attached to this ordinance and made a part hereof. New material is shown in bold type, and material to be deleted is shown in strike through. The Director of Transportation is authorized to collect such fees in accordance with Chapter 15.04 of the Seattle Municipal Code. Section 2. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal Code Section 1.04.020.
