ORDINANCE __________________
AN ORDINANCE related to land use and zoning, amending Section 23.70.004 of the Seattle Municipal Code, deleting the Graham Street light rail station area from the Station Area Interim Overlay District by repealing Exhibit 1C.
Whereas, the Station Area Interim Overlay District was established in March 1999 by Ordinance 119394 around proposed Sound Transit Link light rail stations for the purpose of preserving opportunities for transit and pedestrian oriented development in
accordance with Council approved goals and objectives; and
Whereas, based on community input from citizens in southeast Seattle, the City adopted Resolution 30133 in March 2000, recommending to the Sound Transit Board of Directors that Link light rail system funding not be used now to acquire property to
preserve the opportunity to build a future light rail station at South Graham Street and Martin Luther King, Jr. Way South; and
Whereas, the Sound Transit Board is considering a resolution to defer the construction of the Link light rail station at South Graham Street and Martin Luther King, Jr. Way South; and
Whereas, the Station Area Interim Overlay District is intended to apply only to Link light rail stations that are part of the Locally Preferred Alternative approved by the Sound Transit Board;
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE, AS FOLLOWS:
Section 1. Section 23.70.004 of the Seattle Municipal Code, as last amended by Ordinance 119672, is amended to repeal Exhibit 1C to delete the Station Area Interim Overlay District as it applies to the proposed Graham Street light rail station, and
re-label the remaining exhibits as follows:
23.70.004 Station Area Interim Overlay District established.
There is hereby established pursuant to Chapter 23.59 of the Seattle Municipal Code, the Station Area Interim Overlay District, as depicted on Exhibit 1A-1IJ, following this Chapter 23.70.

Section 2. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by Municipal
Code Section 1.04.020.
