A RESOLUTION relating to the Seattle Department of Parks and Recreation; authorizing applications for grant funding assistance to the Washington Recreation and Conservation Office for Wildlife and Recreation Program projects as provided in Chapter
79A.15, Revised Code of Washington, and Title 286, Washington Administrative Code; and authorizing applications for grant funding assistance to the Recreation and Conservation Office for Aquatic Lands Enhancement Account projects as provided in Revised
Code of Washington 79.105.150 and Title 286, Washington Administrative Code.
WHEREAS, on November 28, 2011, the Seattle City Council passed Resolution 31336 adopting the Seattle Parks and Recreation 2011 Development Plan; and
WHEREAS, under the provisions of the Washington Wildlife and Recreation Program (WWRP), state grant assistance is available to aid in financing the cost of facility development; and
WHEREAS, under the provisions of the Aquatic Lands Enhancement Account (ALEA), state grant assistance is available to aid in financing the cost of habitat acquisition, protection, and restoration; and
WHEREAS, WWRP and ALEA grants are administered by the State of Washington Recreation and Conservation Office (RCO) on behalf of the State of Washington Recreation and Conservation Funding Board; and
WHEREAS, it is the intent of the City Council and Mayor that the Arboretum Waterfront Trail project will be established in subsequent legislation; and
WHEREAS, the Jimi Hendrix Park is included in the Department of Parks and Recreation's 2012 2017 Capital Improvement Program, and
WHEREAS, it is the intent of the City Council and Mayor that the Yesler Terrace Neighborhood Park Development project will be established in subsequent legislation; and
WHEREAS, any grant assistance received will be used for direct costs associated with implementation of the projects referenced above; and
WHEREAS, the City of Seattle (City) certifies that the City's matching share of project funding will be derived from the 2000 Pro Parks Levy, the 2008 Parks and Green Space Levy, the Washington State Department of Transportation, and donations; and
WHEREAS, the City is responsible for supporting all non-cash commitments to this project should they not materialize; and
WHEREAS, the City acknowledges that the grant assistance, if approved, will be paid on a reimbursement basis, meaning the City will only request payment from RCO after eligible and allowable costs have been incurred and payment remitted to vendors, and
that RCO will hold retainage until the project is deemed complete; and
WHEREAS, the City acknowledges that any facility developed with grant assistance from the Recreation and Conservation Funding Board must be dedicated for public outdoor recreation purposes, and be retained and maintained for such use for perpetuity
unless otherwise provided and agreed to by the City and the Recreation and Conservation Funding Board; and
WHEREAS, the City acknowledges that any facility developed through grant assistance from the Recreation and Conservation Funding Board must be reasonably maintained and made available to the general public at reasonable hours and times of the year
according to the type of area or facility unless other restrictions have been agreed to by the RCO Director or the Recreation and Conservation Funding Board; and
WHEREAS, the City has read the state guidelines relating to RCO's ALEA and WWRP programs and agrees to abide by those guidelines and policies; and
WHEREAS, this Resolution is a requirement to be eligible for RCO funding and becomes part of a formal application to RCO for grant assistance; and
WHEREAS, the City provided appropriate opportunity for public comment on this application; and
WHEREAS, the City considers it in the best public interest to complete the projects described in the applications; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE, THE MAYOR CONCURRING, THAT:
Section 1. The Superintendent of the Department of Parks and Recreation (Superintendent), or his designee, is hereby authorized to submit applications for and on behalf of the City, in such counterparts as are necessary, to RCO, for financial assistance
in the amount set forth in the "Grant Request" column below:

The One Million Five Hundred Thousand ($1,500,000) of RCO grants require a dollar for dollar match. The funding match for the Jimi Hendrix Park project was included in the City's 2014 Adopted Budget. It is the intent of the City Council and Mayor that
the funding match for the Arboretum Waterfront Trail and the Yesler Terrace Neighborhood Park project will be appropriated in separate legislation.
Section 2. The Superintendent, or his designee, is further authorized to act as the representative of the City to provide such information and documents as may be required in connection therewith.
