WHEREAS, King County Department of Natural Resources and Parks, Wastewater Treatment Division ("KCWTD") has applied for permission to construct green stormwater infrastructure facilities including underground injection control ("UIC") wells and
associated green stormwater infrastructure systems to reduce stormwater flows from the Green Stormwater Infrastructure ("GSI") Drainage Area to the combined sewer system and the frequency of combined sewer overflow ("CSO") events at King County's Barton
CSO outfall to Puget Sound; and
WHEREAS, the GSI Drainage Area will be implemented and installed in two phases, if necessary, as outlined and illustrated on Attachment A; and
WHEREAS, KCWTD has determined that installing and implementing the UIC wells and associated GSI systems are KCWTD's preferred option for complying with KCWTD's National Pollution Discharge Elimination System Waste Discharge Permit for the West Point
Wastewater Treatment Plant, which requires that KCWTD limit CSO events to Puget Sound at the Barton Street Pump Station to no more than one overflow per year; and
WHEREAS, KCWTD will be regulated under the UIC well program of the Washington State Department of Ecology in Washington Administrative Code Chapter 173-218 and under other legal requirements; and
WHEREAS, construction of the UIC wells and associated GSI systems will be entirely within the City right-of-way in accordance with City standards and Seattle Municipal Code Chapters 22.800-22.808 that requires projects to implement GSI to the maximum
extent feasible; and
WHEREAS, in making a recommendation, the Director of the Seattle Department of Transportation ("Director") considered the submitted plans and application materials for constructing the UIC wells and associated GSI systems; and recommends that conceptual
approval be granted; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEATTLE, THE MAYOR CONCURRING, THAT:
Section 1. The City Council finds that the UIC wells and associated GSI systems are in the public interest.
Section 2. As conditions for obtaining permission to construct the UIC wells and associated GSI systems project, the KCWTD shall:
(1) Provide civil engineering, landscape, and utility plans to the Seattle Department of Transportation for reviewing and permitting;
(2) Provide public liability insurance naming the City as an additional insured or in the form of self-insurance, either as approved by the City's Risk Manager;
(3) Obtain all other necessary land use or building permits;
(4) Pay all City permit fees; and
(5) Remove the UIC wells and associated GSI systems and restore the right-of-way to its original condition if KCWTD fails to perform an obligation under the term permit within a reasonable time after receiving notice by the City specifying such
failure.
Section 3. After this resolution is adopted, SDOT will present to the Council for its modification or approval, a draft term permit ordinance that prescribes the conditions under which permission to use the right-of-way will be granted.
Section 4. As recommended by the Director and the Mayor, conceptual approval for construction of the UIC wells and associated GSI systems project is GRANTED.
