AN ORDINANCE relating to the construction of a new Fire Station 32; transferring jurisdiction of a portion of Lots 1 through 4, Block 1, Norris' Addition to West Seattle from the Department of Finance and Administrative Services to the Seattle
Department of Transportation and dedicating the property for alley purposes; and laying off, opening, widening, extending, and establishing the transferred property as street right of way.
WHEREAS, the Fire Facilities and Emergency Response Levy Program proposed under Ordinance 121230 was approved by Seattle voters on November 4, 2003; and
WHEREAS, the Fire Facilities and Emergency Response Levy Program is funded pursuant to Ordinance 121380, and provides for the rebuilding of Fire Station 32 at its existing location; and
WHEREAS, as a condition of the land use permit requested for the construction of the new Fire Station 32, the Department of Planning and Development requires that the Department of Finance and Administrative Services transfer the south two feet of Lots
1 through 4 and the east 2 feet of Lot 4 to the existing adjacent alleyways, all located in Block 1, Norris' Addition to West Seattle, to the Seattle Department of Transportation for public right of way; and
WHEREAS, the Procedures for the Evaluation for Reuse and Disposal of the City's Real Property, as amended by Resolution 30862, provide in Section 7.2 that jurisdiction of fully utilized municipal use properties may be transferred between departments to
better align their missions with their responsibilities; and
WHEREAS, the Department of Finance and Administrative Services and the Seattle Department of Transportation recommend transferring jurisdiction of the real property described in Section 1 below for street purposes; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Jurisdiction over the following described real property is hereby transferred from the Department of Finance and Administrative Services to the Seattle Department
of Transportation and dedicated for street purposes:
The south 2.00 feet and the east 2.00 feet of the following described property:
Lots 1, 2, 3 and 4, Block 1, of Norris' Addition to West Seattle, as per plat recorded in Volume 14 of Plats, page 93, records of King County;
Except that portion thereof condemned by the City of Seattle for West Alaska Street in Superior Court Cause No. 70682, under Ordinance No. 21302 of the City of Seattle;
Situate in the City of Seattle, King County, Washington State;
Together with, the right to make all necessary slopes for cuts or fills upon the abutting property in the reasonable original grading of the street to be established over and across the lands described above.
As graphically represented in Attachment 1 to this ordinance.
Section 2. The real property as legally described in Section 1 is hereby laid off, opened, widened, extended and established as street right of way.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section
1.04.020.
