AN ORDINANCE relating to the City Light Department, declaring as surplus and authorizing the Superintendent or his designee to release four (4) easements for electrical service located within City of Seattle Short Subdivision Nos. 3005320, 3008464, and 3012055.

WHEREAS, these easements have been abandoned for distribution purposes and are no longer required or useful for City Light Department purposes; and

WHEREAS, The Superintendent of City Light has recommended that release of these easements in the attachment hereto; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:

Section 1. Pursuant to RCW 35.94.040 and after public hearing, the following described easements are found to be surplus to the City's needs and no longer required for providing public utility service:

1) That certain easement dated June 25, 2007, and recorded under Recording Number 20070626900012 in King County, Washington, lying within that property legally described as Parcels A, B, C, D and E, City of Seattle Short Subdivision No. 3005320 (P.M. #250418-4-030).

2) That certain easement dated September 22, 2011, and recorded under Recording Number 20110922900005 in King County, Washington, lying within that property legally described as Parcels A, B, and C, City of Seattle Short Subdivision No. 3012055 (P.M. #260421-4055).

3) That certain easement dated May 7, 2009, and recorded under Recording Number 20090518001541 in King County, Washington, lying within that property legally described as Parcel R, City of Seattle Short Subdivision No. 3008464 (formerly known as Parcel A of City of Seattle Lot Boundary Adjustment No. 2102464, Recording No. 20020513900007) (P.M. #250311-4-006B).

Section 2. The Superintendent of the City Light Department or his designee is authorized to release the easements over the properties legally described above by executing "Release of Easement" documents substantially in the forms shown in Attachments 1, 2, 3 and 4 hereto.

Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Seattle Municipal Code Section 1.04.020.
