AN ORDINANCE relating to the solid waste system of Seattle Public Utilities; establishing rates and charges for solid waste services for the One Less Truck Pilot Program; and amending Chapter 21.40.050 of the Seattle Municipal Code.
WHEREAS, Resolution 30990 outlines actions to be taken to reach the City's goal of recycling 60% of the waste produced within the City, including direction to conduct a pilot project to test the costs, benefits, and operational impacts associated with
an every other week frequency for garbage collection; and
WHEREAS, Seattle Public Utilities is establishing an One Less Truck Pilot Program (Program) for six months, which should be completed no later than January 31, 2013, so that it can use the test results in determining whether to implement every other
week garbage collection frequency City-wide; and
WHEREAS, a change in City-wide garbage collection frequency to every other week would reduce collection costs for Seattle Public Utilities; and
WHEREAS, as part of the Program, Seattle Public Utilities wishes to establish temporary rates applicable during the Program and to test alternative rate structures; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. Section 21.40.050.A of the Seattle Municipal Code is amended as follows:
21.40.050 Residential can rates and charges.
A. Charges for residential can garbage and rubbish collection and disposal service shall be in accordance with the following schedules:
1. All residences with curbside/alley garbage container pickup , except residences assigned to the One Less Truck Pilot Program, as set forth in subsection 21.40.050.A.12 : a charge per month or portion thereof, for once-a-week service for each
service unit subscribed to, billed directly to the owner, homeowner association, or occupant thereof as follows:

12. Seattle Public Utilities shall conduct an One Less Truck Pilot Program (Program) for approximately 800 residences assigned to participate in the Program for six months, to be completed no later than January 31, 2013. All residences assigned
to the Program shall be billed a charge per month or portion thereof, for every other week service for each service unit subscribed to, billed directly to the owner, homeowner association, or occupant effective for the six-month Program to be completed
no later than January 31, 2013, as follows:

For residents with backyard garbage container pickup:
A rate equal to 1.4 times the "A" or "B" Program rate for curbside/alley garbage pickup.
The SPU Director is authorized to assign approximately 800 residences to participate in the Program and assign each participating residence to either the "A" or "B" rate structure.
The SPU Director is authorized to pay a stipend of up to $100 to each residence participating in the Program no later than two months after the end of the Program, the amount of which the SPU Director shall determine based on the rate paid by each
residence during the Program.

Section 2. The provisions of this ordinance are declared to be separate and severable. If any one or more of the provisions of this ordinance shall be declared by any court of competent jurisdiction to be contrary to law, then such provision or
provisions shall be null and void and severed from the rest of this ordinance, and all other provisions of this ordinance shall remain valid and enforceable.
Section 3. This ordinance shall take effect and be in force 30 days after its approval by the Mayor, but if not approved and returned by the Mayor within ten days after presentation, it shall take effect as provided by Municipal Code Section
1.04.020.
